Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and the operator of the Moonseum service (“Moonseum,” “we,” “us,” or “our”). They govern your access to moonseum.io and any related pages, APIs, account tools, discovery features, and services that link to these Terms (collectively, the “Service”). By accessing or using the Service, creating an account, or connecting a wallet, you agree to these Terms and our Privacy Notice. If you do not agree, do not use the Service. The Service currently provides NFT and collection discovery, market information, watchlists, profiles, account tools, and collection or listing drafts. Moonseum-native trading, settlement, offers, checkout, and mint execution are not enabled. Additional transaction terms and disclosures may apply if those features are introduced.

You must be at least 18 years old and legally capable of entering a binding contract. You may not use the Service if you are located in, ordinarily resident in, organized under the laws of, or acting for a person in a jurisdiction subject to comprehensive applicable sanctions, or if you or a party you represent is listed on an applicable government restricted-party list. You may not use the Service where doing so would violate law, regulation, court order, or these Terms. You represent that you meet these requirements and are not using the Service for another person who does not. We may restrict, suspend, or terminate access to meet legal, security, sanctions, fraud-prevention, or operational obligations.

Some features require an email account, a compatible Solana wallet, or both. You must provide accurate information, keep account credentials secure, and promptly report suspected unauthorized access through an available support channel. You are responsible for activity authorized through your credentials or wallet to the extent permitted by law. Moonseum is designed to be non-custodial. We do not ask for or control your private keys or seed phrase. Never disclose either to us or anyone claiming to represent us. Wallet software and blockchain networks are third-party systems outside our control. A connected wallet address is public and may be associated with your profile and public blockchain activity.

The Service may display collection, token, ownership, price, listing, volume, rarity, and other information obtained from public blockchains or third-party providers. This information may be delayed, incomplete, inaccurate, unavailable, or changed by its source. It is provided for discovery and informational purposes, not as investment, legal, tax, accounting, or financial advice. Third-party marketplaces, wallets, websites, RPC providers, and applications have their own terms and privacy practices. Moonseum does not control them and is not responsible for their acts, omissions, availability, security, content, or transaction outcomes.

Digital assets are speculative and may lose some or all value. Blockchain transactions can be irreversible. Smart contracts, wallets, networks, token metadata, media hosting, and marketplace integrations may contain defects or be exploited, upgraded, paused, forked, or discontinued. Network congestion and fees may change without notice. A token may be counterfeit, stolen, subject to competing claims, or linked to content that becomes unavailable. You are solely responsible for evaluating assets, counterparties, collection authenticity, permissions, transaction details, taxes, and legal consequences before authorizing any transaction. Moonseum does not guarantee value, liquidity, authenticity, title, intellectual-property rights, creator royalties, or future utility.

Any fee, network charge, royalty, or total payable through a future transaction feature will be shown before wallet approval to the extent available. Blockchain network fees and third-party charges are set or collected by others and may change. ALL COMPLETED BLOCKCHAIN TRANSACTIONS, DIGITAL-ASSET SALES, MINTS, AND SERVICE FEES ARE FINAL AND NON-REFUNDABLE. MOONSEUM DOES NOT OFFER RETURNS, CANCELLATIONS, REVERSALS, CHARGEBACKS, OR REFUNDS FOR CHANGE OF MIND, PRICE MOVEMENT, NETWORK FEES, THIRD-PARTY FAILURE, LOST ACCESS, OR USER ERROR. You must verify every transaction before signing. This no-refund rule applies to the maximum extent permitted by law and does not exclude a remedy that cannot lawfully be waived.

Moonseum and its licensors retain all rights in the Service, including its software, design, branding, and original content. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. Creators and other users retain responsibility for content they submit. By submitting content, you grant Moonseum a worldwide, non-exclusive, royalty-free license to host, reproduce, format, display, and distribute it as needed to operate, secure, and promote the Service. You represent that you have all necessary rights and that your content does not infringe, deceive, defame, violate privacy or publicity rights, or break law. Ownership of an NFT does not itself transfer copyright or other intellectual-property rights in associated media.

You may not: violate law or sanctions; facilitate fraud, theft, money laundering, terrorist financing, or unlawful gambling; manipulate markets, wash trade, spoof activity, or misrepresent price or demand; offer counterfeit, stolen, infringing, or unlawfully obtained assets; evade access controls; interfere with or overload the Service; probe or exploit vulnerabilities without written authorization; introduce malware; scrape or automate access in violation of published limits; impersonate another person; harvest personal data; or use the Service to harm others. We may remove content, invalidate off-chain drafts, limit requests, preserve evidence, or cooperate with lawful requests when reasonably necessary to protect users, the Service, or third parties.

You are responsible for identifying, reporting, and paying all taxes, duties, assessments, and reporting obligations arising from your use of the Service or digital assets. Moonseum does not determine whether an asset or activity is a security, commodity, collectible, financial product, or regulated service for your circumstances. Nothing on the Service is an offer, solicitation, recommendation, fiduciary service, broker service, exchange service, or promise of profit.

We may modify, suspend, restrict, or discontinue any part of the Service, including features, providers, data sources, or account access. We may terminate or suspend your access for breach, suspected fraud or security risk, legal compliance, or material operational risk. You may stop using the Service at any time and may use account settings to export or delete supported off-chain account data. Sections that by their nature should survive termination—including ownership, risk allocation, disclaimers, liability limits, indemnity, and disputes—will survive.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” MOONSEUM AND ITS CONTRIBUTORS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. We do not warrant uninterrupted or error-free operation, that data is accurate or complete, that defects will be corrected, or that the Service or third-party systems are secure.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOONSEUM AND ITS OPERATORS, CONTRIBUTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY; DIGITAL-ASSET LOSS OR VALUE CHANGE; WALLET COMPROMISE; OR THIRD-PARTY OR BLOCKCHAIN CONDUCT, EVEN IF ADVISED OF THE POSSIBILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY ARISING FROM THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF US$100 OR THE SERVICE FEES YOU PAID DIRECTLY TO MOONSEUM DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits do not apply where prohibited or to liability that cannot legally be limited.

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Moonseum and its operators, contributors, affiliates, licensors, and service providers from third-party claims, damages, losses, liabilities, and reasonable costs arising from your content, your unlawful or unauthorized conduct, your breach of these Terms, or your infringement of another person’s rights. This obligation does not apply to the extent a claim results from the indemnified party’s own unlawful conduct.

Before filing a claim, you and Moonseum agree to attempt in good faith to resolve it informally for 30 days after written notice describing the dispute and requested relief. Nothing prevents either party from seeking urgent injunctive relief, reporting to a regulator, or using a small-claims process where eligible. These Terms are governed by the laws that apply to the Moonseum operator and the user’s relationship with the Service, without overriding mandatory consumer protections that apply in the user’s place of residence. Exclusive forum, arbitration, jury-waiver, and class-waiver provisions are not imposed by these Terms. A competent court will determine jurisdiction and venue under applicable law.

We may update these Terms as the Service or law changes. We will post the revised version and effective date. If a change materially reduces your rights or increases your obligations, we will provide reasonable notice through the Service where practicable. Continued use after the revised Terms take effect constitutes acceptance; if you do not agree, stop using the Service and delete your account.

These Terms and the Privacy Notice are the entire agreement about the Service. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them with the Service or its operator. Headings are for convenience. Electronic notices and acceptance satisfy written-form requirements to the extent permitted by law.

Authenticated users may submit privacy requests, export data, and delete their account through Account & Privacy settings. General support and legal notices may be submitted through any verified support channel published within the Service. Never include a seed phrase, private key, password, or unnecessary wallet signature in a notice.
